The Queensland Court of Appeal refused leave to appeal against a District Court decision that had dismissed an appeal from Magistrates Court convictions for unauthorised damage to property and obstructing police. The Court found that the applicant's challenges were entirely factual, that the evidence was internally consistent and not contradicted, and that the Magistrate's findings were open on the evidence. The applicant's failure to give evidence at trial and failure to call available witnesses at trial could not be remedied on appeal.
