For armed robbery involving a firearm, threats to shoot and kill, and a prior history of violence (but no prior armed robbery), a sentence of 8 years with a serious violent offence declaration is appropriate where the offender has a substantial crime-free period and the offence was not well-planned. A sentence of 12 years was manifestly excessive in such circumstances. A serious violent offence declaration may be appropriate even where the sentence is below 10 years where a gun was used with repeated threats to kill.
