Where propensity evidence is adduced to identify the accused as the perpetrator, the jury need not be directed that they must first be satisfied beyond reasonable doubt of the propensity evidence before using it to support an inference of guilt. Propensity evidence is to be treated as a strand in the reasoning process assisting identification, not as a separate indispensable link. Admissions made by counsel on a prior guilty plea are prima facie admissible as admissions by an agent with ostensible authority. An appropriate sentence for breaking and entering a dwelling house followed by rape of the occupant in her own home is in the range of 15 years imprisonment.
