The Queensland Court of Appeal held that s 7 of the Criminal Code (Qld), which provides for complicity and aiding and abetting, does not have general application to all statutory offences in Queensland but applies only to offences under the Criminal Code itself. The Court reviewed extensive case authority and the historical context of the Criminal Code Act 1889, concluding that the provisions of the Code were not intended to supplement offences created by other statutes such as the Corrective Services Act 1988. Where a separate statute contains its own complementary offence provisions (as the Corrective Services Act did), s 7 of the Code does not extend to create ancillary liability for offences under that statute. Leave to appeal was granted but the appeal was dismissed.
