The Court of Appeal held that a real estate agent was not entitled to commission on a property sale where, at the time of introducing the buyer and conducting negotiations, the agent did not hold a real estate agent's licence as required under s 19 of the Auctioneers and Agents Act 1971 (Qld). The Court also considered whether a written appointment in a clause of the contract of sale could satisfy the requirements of s 76(1)(c) of the Act, and interpreted the meaning of 'transaction' within s 76(1). The appeal was allowed, judgment was entered for the defendant, and the cross-appeal was dismissed.
