An easement granting the right to lay pipes and wires for the supply of water and other services does not, without more, confer a right to draw water from a bore on the servient tenement. The power to 'modify' an easement under s 181 of the Property Law Act 1974 (Qld) is a power to limit or restrain rights, not to increase them. Courts will be reluctant to modify an easement to increase the rights of the dominant tenement, particularly where the modification would substantially injure the servient tenement owner.
