Statutory imposts including taxes, levies, WorkCover premiums, and penalties for late payment of such imposts are 'debts' 'incurred' within s 588G of the Corporations Law. The 'loss or damage' recoverable under s 588M(2) is the quantum of unpaid debts without abatement for prospective dividends, profit components, or the value of statutory charges. Directors who continue to trade an insolvent company knowing of extant statutory liabilities and the risk of penalties, without appointing an administrator under Part 5.3A, will be liable for those penalties as debts incurred.
