An injunction to restrain payment of moneys to which a defendant is entitled under a contract, sought for the purpose of preserving those moneys to satisfy a potential damages award, is properly characterised as a Mareva injunction requiring proof of risk of dissipation. Even if characterised as an ordinary interlocutory injunction, the balance of convenience will not favour the plaintiff where the effect is to require the defendant to provide pre-trial security for the plaintiff's damages claim.
