A relationship akin to mother and son between a deceased and her adult brother, sustained over the brother's entire life, can give rise to a 'responsibility to make provision' under s 91(1) of the Administration and Probate Act 1958 (Vic) as amended in 1997. The concept of responsibility is not confined to legal or financial obligations but extends to moral responsibilities arising from the nature of the relationship. An adult male claimant is not in a special class with particular difficulties merely because he is prima facie able to maintain and support himself.
