An Edwards direction regarding lies is not required where lies are relied upon only as going to credit and not as evidence of consciousness of guilt. A claim of miscarriage of justice through default of defence counsel must be supported by credible evidence establishing the alleged default; inconsistent accounts given by the accused across multiple proceedings will undermine such a claim. Where an appeal ground impugns former counsel's conduct, the former practitioner must be notified in writing and invited to respond on affidavit, with legal professional privilege expressly waived.
