A foreign national who deliberately joins a substantial criminal enterprise while in Australia for another purpose (such as a holiday) can expect little if any discount for the hardship of imprisonment in a foreign country, as the probable consequence of apprehension is equally obvious from the start. The quantity of drug imported is only one of many factors in the sentencing discretion, and comparative sentencing arguments are of limited utility where the circumstances of offending and offenders differ significantly.
