A barrister jointly retained with another barrister for the same client in the same litigation does not owe a duty of care to the co-counsel to take reasonable care to avoid causing the other financial loss. The duty of co-counsel is to the client, not to each other, and recognising such a duty would create potential conflicts with the barrister's primary obligations to the client and to the court. The reasoning may extend to analogous co-worker relationships in other professions, but that question was expressly left open.
