A worker claiming a significant disability (not less than 16% but less than 30%) cannot refer the question of degree of disability to the Director under s 93D(5) after the election period under s 93E(3)(b) has expired and no extension under s 93E(6) or (7) applies. The dispute resolution procedure under s 93D is purposively linked to the election scheme under s 93E and has no independent operation once the election period has passed. The question whether multiple disabilities may be aggregated in a single referral under s 93D(5) remains open.
