Where an undercover police operation merely provides an offender with the opportunity to commit drug offences the offender was already disposed to commit, without encouragement or incitement, there is no basis for leniency in sentencing. A sentencing judge should be fully appraised of the factual situation where there is any background of entrapment or undercover police involvement, but failure to inform the judge does not necessarily vitiate the sentence if the sentence is otherwise appropriate. The fact that drugs sold to an undercover officer never reached the streets provides no mitigation where the offender believed they would.
