Where a conviction has been obtained on the basis of perjured evidence and the complainant and a key witness have subsequently been convicted of conspiring to pervert the course of justice by fabricating the complaint, a verdict of acquittal rather than a new trial is the appropriate order. The Court of Criminal Appeal retains jurisdiction to enter a verdict of acquittal notwithstanding High Court dicta suggesting retrial decisions should be left to the Executive.
