A Full Bench of the AIRC hearing an appeal under s 45 of the Workplace Relations Act does not commit jurisdictional error merely by misinterpreting eligibility rules or misapplying them to the facts; such errors are within jurisdiction unless the Full Bench asks the wrong question, identifies the wrong issue, ignores relevant material, or relies on irrelevant material. Prior findings by a tribunal member on questions of fact in an unrelated proceeding do not give rise to apprehended bias where the question of fact in the later proceeding is different. Inadequacy of reasons by a first-instance decision-maker cannot justify dismissal of the underlying application on appeal.
