Where a solicitor's negligence causes a client's claim to become statute-barred, the client is entitled to the full value of the lost claim without discount where there is no uncertainty the claim would have succeeded. New issues involving factual and discretionary considerations (such as the value of a contingent right to seek leave to extend time) cannot be raised for the first time on appeal.
