An employer does not owe a duty of care to conduct disciplinary proceedings so as to avoid psychiatric injury to the employee, because such a duty would be incoherent with the statutory disciplinary scheme, employment law mechanisms for adjusting employer-employee interests, and administrative law principles limiting compensatory damages for administrative action. A resignation submitted to a superior officer who is an emanation of the employer is received by the employer even if diverted from its normal processing path, and cannot be unilaterally withdrawn after receipt. Section 78 of the Teaching Services Act 1980 addresses only vacation of a position, not termination of employment in the Teaching Service.
