The discretion to dismiss proceedings under Pt 53 r4 for failure to comply with security for costs orders is broad and unfettered, with no minimum period of default required before dismissal may be ordered. A court exercising this discretion may properly take into account the plaintiff's inability to fund the proceedings to completion, prejudice to the defendants from indefinite stay, the position of the Court and its resources, and the history of the proceedings. The fact that dismissal may cause limitation bars to descend on some claims does not necessarily constitute error if the matter was not raised before the primary judge and the prospect of the plaintiff obtaining funding was in any event remote.
