A mortgagor seeking to restrain a mortgagee by interlocutory injunction must establish a prima facie case that nothing is owing under the mortgage; once it appears that something is owing, a dispute as to quantum alone will not support an injunction. Estoppel by convention may preclude a mortgagor from denying advances were made where the parties conducted their relationship on the basis that advances had been made, notwithstanding non-compliance with formal requirements of the loan agreement.
