Under s 263(2) of the Local Government Act 1993 (NSW), the Boundaries Commission has no obligation to seek ministerial approval to hold a public inquiry; the statute confers a power, not a duty. A decision not to seek approval for an inquiry, particularly where the Minister has indicated an inquiry should not be held, cannot of itself constitute or evidence a failure to have regard to mandatory statutory considerations under s 263(3).
