The power of review under Pt 61 rr 3 and 4 of the Supreme Court Rules and the power to discharge or vary under s 46(4) of the Supreme Court Act 1970 (NSW) are distinct and concurrent. A single Judge of Appeal may review a Registrar's decision under Pt 61 rr 3 and 4 notwithstanding that s 46(4) confers a separate power on the Court of Appeal. The Pt 61 r 3 review does not require demonstration of error of principle, unlike the s 46(4) power.
