A cinema operator with automatically retracting seats owes a duty to warn patrons of the retraction mechanism, as there is a reasonably foreseeable risk that patrons returning to seats in a darkened cinema may not know the seats have retracted. A warning sign in the foyer and cinema is a simple and adequate precaution. Where a plaintiff did not know of a hazard, the overwhelming inference is that a warning would have caused the plaintiff to take care to avoid the hazard, and a trial judge's finding to the contrary will be overturned on appeal.
