Under Pt 72A r 5(1)(b) of the Supreme Court Rules, 'notice of the award' means notice that the award has been made and is available for collection; it does not require service of the award with reasons, nor need it state the result of the arbitration. Time does not commence to run unless notice is given by or on behalf of the arbitrator — delivery of the award by a party without the arbitrator's authority is insufficient. The Court disapproved the view in Cadoroll v Mauntill that notice must state whether the decision is favourable or unfavourable.
