Demonstration of error in the sentencing process does not oblige the Court of Criminal Appeal to impose a lesser sentence; the appeal must be dismissed unless the Court is of the view that a less severe sentence is warranted in law. Driving at close to 100 km/h in a 60 km/h zone near a railway station in the early evening constitutes a very serious case under s 52A(3) warranting a substantial custodial sentence.
