A sentencing judge who sentences for a completed offence when the offender has pleaded guilty only to an attempt commits a fundamental error that is not saved by s 6(3) of the Criminal Appeal Act 1912. Guideline judgments for completed offences (such as R v Henry for armed robbery) cannot be applied as the datum for sentencing for the corresponding attempted offence. It is impermissible to enlarge the head sentence for the purpose of allowing an extended period on parole.
