A court's jurisdiction is not removed by pre-trial executive conduct in compelling a vessel to return to territorial waters; the remedy lies in abuse of process, not want of jurisdiction. Evidence of a witness's status as an accomplice (including an undertaking to cooperate) is admissible notwithstanding the credibility rule in s 102 of the Evidence Act 1995 (NSW). Life imprisonment without parole remains appropriate for principals in the most serious drug importation offences, and a sentencing judge who imposes the maximum penalty need not separately catalogue reasons for not fixing a non-parole period where the reasons for the maximum sentence inherently exclude one.
