Failure to consider that offences were committed while on parole constitutes a legal error permitting appellate intervention. The use of a blood-filled syringe in armed robbery is at or beyond the outside limits of seriousness contemplated by the Henry guideline for weapon use. Where multiple discrete armed robberies are committed over a period of weeks, the starting point should be partially consecutive sentences, not fully concurrent sentences adjusted upward for totality. Aboriginal offenders are not entitled to special leniency by reason of Aboriginality, but mitigating factors that may occur more frequently in Aboriginal communities must be taken into account under general sentencing principles.
