Multiple pieces of weak identification evidence do not cumulatively strengthen a prosecution case for the purposes of assessing whether it was reasonable to institute proceedings under s 3(1)(a) of the Costs in Criminal Cases Act 1967 (NSW). Where all evidence was available before prosecution and consisted of equivocal identifications and circumstantial evidence not excluding reasonable hypotheses other than guilt, it is not reasonable to institute proceedings.
