Where the total weight of cannabis seized includes commercially useless stem and moisture, the question of actual saleable quantity is a matter of mitigation on which the offender bears the onus of proof. A suspended sentence for supply of a commercial quantity of cannabis is manifestly inadequate absent exceptional circumstances. Delay of over 8 months between sentencing and hearing of a Crown appeal, combined with the offender's rehabilitation, may preclude the imposition of full-time custody on re-sentencing.
