A sentence of periodic detention with a twelve-month non-parole period for an unprovoked assault causing life-threatening injuries (subdural hematoma requiring surgery) is manifestly inadequate, even where the offender has strong subjective circumstances and good rehabilitation prospects. Crown delay in filing a notice of appeal, deficiencies in Crown presentation at first instance, and the special considerations on resentencing after a successful Crown appeal may justify a more lenient resentence than would otherwise be appropriate.
