On a pre-trial application to stay proceedings on the ground of prejudicial publicity, the accused need not demonstrate that they would not receive a fair trial; it is sufficient to show a risk of prejudice such that the interests of justice require a temporary stay. Prejudice need not be directed specifically at the accused — it may arise from extensive media coverage of other unrelated trials where there are sufficient similarities (such as shared ethnic origin, similar offence type, same locality, and same trial judge) to create a risk that a jury might associate the accused with those other matters.
