The parity principle in sentencing does not apply to compensation orders under Pt 4 Div 2 of the Victims Support and Rehabilitation Act 1996 (NSW). A co-offender who is a joint tortfeasor may be ordered to pay the full amount of the victim's loss by way of compensation, with the remedy of seeking contribution from the other co-offender under s 5(1)(c) of the Law Reform (Miscellaneous Provisions) Act 1946. The sentencing judge is not required to apportion compensation between co-offenders, particularly where the co-offender has not yet been sentenced.
