Where non-evidentiary material is inadvertently discovered by a jury during deliberations, the appellate court will assess whether the irregularity affected the verdict by considering the nature and significance of the material, the effectiveness of the trial judge's direction, the strength of the Crown case, and the attitude of trial counsel. A foreperson's statement that the jury had already disregarded the material may be relied upon in that assessment.
