Periodic detention may be appropriate for social security fraud offences under s 29B of the Crimes Act 1914 (Cth) where there is compelling evidence of genuine rehabilitation, including sustained drug rehabilitation, long-term employment, and strong family support, even where the offender has an extensive criminal history and a prior similar offence. However, the Court emphasised that such leniency will not be available on future occasions if the offender reoffends.
