Part 52A rule 9(3) does not exhaustively define the circumstances for ordering costs forthwith; the 'unless the court otherwise orders' exception in rule 9(1) preserves a separate discretion. Three recognised categories warrant departure from the general rule: (1) the application is a separately identifiable or discrete matter; (2) unreasonable conduct by the party against whom costs were ordered; (3) there is much to come in the proceedings and a long time before final disposition.
