Under s 418 of the Crimes Act 1900 (NSW), voluntary intoxication is relevant to the subjective question of whether the accused believed conduct was necessary in self-defence and to the circumstances as perceived by the accused, but is not relevant to the objective assessment of whether the accused's response was a reasonable one. This departs from the common law position in R v Conlon. Section 418 is not a codification of the common law; the accused need not have reasonable grounds for the belief that it was necessary to act as he or she did — a genuine belief suffices.
