A sentencing judge is required by s 9(2)(o) of the Penalties and Sentences Act 1992 (Qld) to have regard to a Community Justice Group report but is not bound to accept its ultimate recommendation. The commission of a violent offence while subject to a community service order for a prior offence of violence against the same complainant is a particularly serious aggravating factor that may justify a custodial sentence notwithstanding strong mitigating factors including remorse, a guilty plea, and a favourable Community Justice Group report.
