The Court of Appeal upheld the apportionment of damages between Cole and Hurst but allowed Cole's appeal in part by substituting judgment in her favour for $25,000 with interest and costs on the Magistrates Court scale. In the related appeal, the Court allowed the insurer Wesfarmers' appeal and dismissed the third party proceedings brought by Hurst against the insurer. Helman J dissented in part.
