Armed robbery cases do not fall into any special category requiring exceptional or special features before a serious violent offence declaration is made under Part 9A of the Penalties and Sentences Act 1992 (Qld). A declaration under s 161B must be made with respect to particular convictions, not as a general declaration of offender status. Drug addiction, even where it is the substantial cause of offending, does not preclude a serious violent offence declaration because the difficulty of permanent rehabilitation and risk of re-offending support the need for community protection.
