The Queensland Court of Appeal refused leave to appeal against sentences of six years imprisonment with a recommendation for parole after two years for fraud as a trustee involving misappropriation of $632,435.44 from trust accounts, with $453,123.00 paid from the Fidelity Guarantee Fund. The Court held that the sentences were not manifestly excessive, notwithstanding the applicants' lack of prior convictions and good work histories, applying the principles in Tilley (1991) 53A Crim R. The Court also addressed the significance of an agreed Schedule of Facts where the nature of some transactions was disputed in oral submissions on appeal.
