For offences of incest and maintaining an unlawful sexual relationship with a daughter, the appropriate sentence absent significant mitigation is at least five to six years' imprisonment. Voluntary confession to police (where no proceedings would otherwise have been brought), a guilty plea, and genuine participation in counselling are significant mitigating factors that may reduce the sentence to four years with parole after 15 months. Sentences for maintaining an unlawful sexual relationship that include acts of incest should be assessed by reference to the sentencing range for incest.
