Where a defendant has demonstrated a plausible defence on the merits, a refusal to set aside a default judgment is an unusually heavy sanction for delay and should not be imposed unless the delay causes irreparable mischief that cannot be compensated by costs. Much less significance is now ascribed to delay than in the past in applications to set aside default judgments.
