The test for joinder under Supreme Court Rules 2000 (Tas), r184(1)(b) is whether the proposed party's rights against or liabilities to any party to the action in respect of the subject matter will be directly affected by any order which may be made, following Pegang Mining Co Ltd v Choong Sam and News Ltd v ARL. A party with an enforceable contractual right over the subject matter of the proceedings (here, an option to purchase) satisfies this test, even where the plaintiff makes no direct claim against that party. The plaintiff's objection to joinder is relevant but not determinative.
