The assessment of whether risk posed by a bail applicant is 'unacceptable' is not a static inquiry but must be judged relative to all circumstances, including the anticipated length of delay before trial. Although the objective risk may remain the same, what constitutes an 'unacceptable' risk changes as the period of pre-trial detention lengthens. Indefinite detention of accused persons awaiting trial will not be tolerated where delay is caused by external factors such as corruption investigations into prosecution witnesses.
