An offence under s 73(1) of the Drugs, Poisons and Controlled Substances Act 1981 (Vic) is not 'an offence punishable by imprisonment' within s 31(1) of the Sentencing Act 1991 (Vic) where the court is satisfied of the mitigatory factors in s 73(1)(a) (small quantity of cannabis, not for trafficking), because the maximum penalty in those circumstances is a fine only. The commission of a triggering offence is not an essential condition of the County Court's jurisdiction to hear a breach charge, so an erroneous finding of breach is not jurisdictional error amenable to certiorari. Declaratory relief is available as an alternative remedy where the applicant has been legally wronged.
