In applications for a stay of professional disciplinary orders pending appeal, the public interest in protecting the community is the dominant consideration and will outweigh the personal and financial hardship of the practitioner, particularly where the misconduct is serious and the appeal does not raise serious prospects of success. Undertakings offered by the practitioner will not suffice where they do little to protect the public interest during the appeal period.
