An applicant for extension of time to appeal against conviction must support the application with proper evidentiary material, not merely bare assertions, and must demonstrate reasonable prospects of success. A prosecutor's misstatement of legal principles in opening address does not constitute a miscarriage of justice where the prosecutor directed the jury to take law from the judge and the judge's directions were adequate.
