On a Director's appeal against sentence under s 567A of the Crimes Act 1958, it is ordinarily necessary for the Director to show manifest inadequacy; a sentencing error alone does not justify intervention if the sentence is within range. Parity requires only that the sentence not engender a justified sense of grievance when objective differences between co-offenders are borne in mind, and a sentencing judge must account for the fact that a co-offender who pleaded guilty received a discount not available to one who stood trial. A Jones v Dunkel direction against the Crown for failure to call a witness will only be given in rare and exceptional circumstances where the prosecution's failure was in breach of its duty to call all material witnesses.
