Section 16(3B) of the Sentencing Act 1991 (Vic) operates as a cumulation directive ensuring that sentences for offences committed on parole are served additionally to any period required on cancellation of parole; it does not require the sentencing court to reduce the sentence being imposed on totality grounds by aggregating it with the unexpired portion of the earlier sentence. Section 5(2AA) prohibits speculation about Parole Board action in either direction. To establish exceptional hardship based on a child's illness as a ground against incarceration, detailed and up-to-date medical evidence is required, including evidence of the specific adverse impact of the parent's incarceration on the child's condition.
